Agreement to Terms
By using our software and mobile application, you agree to follow these usage terms,
non-disclosure of client data, and respect for our privacy policy. All features are
governed by our licensing model. These Terms and Conditions ("Terms") constitute a
legally binding agreement between you and Track Employee regarding your use of our
workforce management platform and related services.
Definitions
- "Platform" refers to the Track Employee software, mobile applications, and web-based services
- "User" refers to any individual or entity accessing or using our Platform
- "Client Data" refers to all data, information, and content uploaded, stored, or processed through our Platform
- "Services" refers to all features, functionalities, and support provided by Track Employee
- "Account" refers to the user account created to access our Platform
Service Description
Track Employee provides a comprehensive workforce management solution that includes:
Telecalling Management
Smart dialing systems, call recording, and performance tracking
Field Tracking
GPS-based location tracking and field agent management
Analytics & Reporting
Comprehensive dashboards and performance analytics
Team Management
Role-based access control and team collaboration tools
User Accounts and Registration
Account Creation
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized use of your account
- One person or entity may not maintain multiple accounts without our consent
Account Responsibilities
- You are responsible for all activities that occur under your account
- You must ensure that all users in your organization comply with these Terms
- You must maintain appropriate security measures for your account access
Acceptable Use Policy
Permitted Uses
You may use our Platform for legitimate business purposes including:
- Managing and tracking your workforce and field operations
- Monitoring employee performance and productivity
- Generating reports and analytics for business insights
- Communicating with team members through integrated tools
Prohibited Uses
You agree not to use our Platform for:
- Any unlawful purpose or in violation of applicable laws
- Harassment, abuse, or harm to other users or third parties
- Uploading malicious code, viruses, or harmful content
- Attempting to gain unauthorized access to our systems
- Reverse engineering, decompiling, or disassembling our software
- Reselling or redistributing our services without authorization
Data Protection and Confidentiality
Client Data Ownership
You retain all rights, title, and interest in your Client Data. We do not claim
ownership of any data you upload, store, or process through our Platform.
Data Security Obligations
- We implement industry-standard security measures to protect your data
- You are responsible for maintaining appropriate data backup procedures
- You must comply with applicable data protection laws and regulations
- You agree to report any suspected security breaches immediately
Confidentiality
Both parties agree to maintain the confidentiality of all proprietary and
confidential information shared during the use of our services.
Subscription and Payment Terms
Subscription Plans
- Various subscription plans are available with different features and limitations
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as expressly stated in our refund policy
Payment Processing
- Payments are processed through secure third-party payment processors
- You authorize us to charge your designated payment method
- Failed payments may result in service suspension or termination
- Price changes will be communicated with at least 30 days' notice
Intellectual Property Rights
Our Intellectual Property
The Platform, including all software, designs, text, graphics, and other content,
is owned by Track Employee and protected by intellectual property laws.
License Grant
We grant you a limited, non-exclusive, non-transferable license to use our Platform
in accordance with these Terms during your subscription period.
Restrictions
- You may not copy, modify, or create derivative works of our Platform
- You may not remove or alter any proprietary notices or labels
- You may not use our trademarks without prior written consent

Limitation of Liability
To the maximum extent permitted by law, Track Employee shall not be liable for any
indirect, incidental, special, consequential, or punitive damages, including but not
limited to loss of profits, data, or business opportunities.
Our total liability for any claims arising from or related to these Terms or the
Platform shall not exceed the amount paid by you for the services during the
twelve months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Track Employee from and against
any claims, damages, losses, or expenses arising from:
- Your use of the Platform in violation of these Terms
- Your Client Data or any content you submit through the Platform
- Your violation of any third-party rights
- Any negligent or wrongful conduct by you or your users
Termination
Termination by You
You may terminate your account at any time by providing written notice.
Termination will be effective at the end of your current billing period.
Termination by Us
We may terminate your account immediately if you violate these Terms or
fail to pay applicable fees.
Effect of Termination
- Your access to the Platform will be discontinued
- We will provide a reasonable opportunity to export your data
- All outstanding fees become immediately due and payable
- Provisions that should survive termination will remain in effect
Dispute Resolution
Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles.
Dispute Resolution Process
- Direct Negotiation: Parties will attempt to resolve disputes through good faith negotiations
- Mediation: If negotiation fails, disputes will be submitted to mediation
- Arbitration: Unresolved disputes will be settled through binding arbitration
- Jurisdiction: Courts in Hyderabad, India have exclusive jurisdiction
Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be
communicated through email or platform notifications at least 30 days before
taking effect. Continued use of the Platform after changes constitutes acceptance
of the modified Terms.
